It is a mandatory, non-stock, non-profit corporation. The purpose of this association is the preservation of economic values within your neighborhood through architectural controls and deed restrictions. In addition, it provides for the maintenance, improvement, preservation and administration of the common facilities. Each Association is governed by a Board of Directors, elected by the owners, operating under the legal documents which established the Association.
The major responsibility of an Association is to protect the investment and enhance the value of the property owned by the members. The Association is empowered to oversee the duties and obligations of the community as to covenants, conditions, restrictions and easements concerning the property; to fix, levy, collect and enforce payment by any lawful means all charges and assessments and to take care of all maintenance and repairs to the common facilities, if any are owned by the Association.
The Lakes of Bella Terra Declaration of Covenants, Conditions and Restrictions (often referred to as "DCC&R's or "Deed Restrictions" are important rules governing your responsibilities as a member of the Association. They are also set up to protect your rights as a homeowner. They are established to make sharing of property and living in harmony convenient and easy for all involved. The Architectural Controls outlined in the deed restrictions are set up, not to stifle your creativity, but rather to ensure that the integrity of the original community design is preserved. According to the DCC&R's, any exterior alteration, addition, modification or change must be submitted to and approved by the Architectural Control Committee/Architectural Review Committee prior to beginning any work. This includes doors, garage doors, windows, roofs, lighting, paint/stain, driveways, fences, landscaping, paver stones, covered patios, decks, storage rooms, pools, spas, play equipment, screen enclosures, room additions, solar panels, solar screens, storm doors, window screen/film, etc.).
It is the homeowner’s responsibility to ensure modification approval is obtained prior to construction. The process begins with an AARC/ACC Applications are made through the Resident portal. Contact the Management Company for additional help or information.

Enforcement remedies are granted to the Association by governing legal documents and each Board of Directors adopts an enforcement policy containing a specific course of action. Generally, violations are cited by the Management Company, during a drive through inspection of the community. Letters are sent out informing residents of violations and asking their cooperation in correcting the problems. If a violation is not corrected within the time frame specified, the Association may hire someone to correct the violation and charge the property owner with the costs incurred (if governing documents allow this) or the Association may hire an attorney and file suit against the property owner. The Board of Directors has the responsibility and the duty to enforce the deed restrictions. It is not optional.
The assessment of your community is set on an annual basis. A budget is developed by your Board of Directors based on operating history and an evaluation of the needs of the community. Assessments may be spent on various services which may include community patrol, trash pick-up, and landscape contracting and maintaining the recreational facilities as well as the accounting and administration of the Association. Any questions regarding billing or account status contact your Association Manager.
Yes. However, in the case of general assessment, the increases are controlled by the Declaration, as well as, by the Board of Directors. The assessments are projected to provide sufficient funds for the day-to -day operation of the community, as well as reserves for making future capital improvements without the need for special assessments.
The assessment is secured by a lien on each lot and /or home and it may be foreclosed by the Association if not paid. If the Association must spend its time and money to collect your assessment, it will harm the Association and eventually you.
Yes. The Association's Declarations Article VIII, Section 3(e) authorizes" the Association to suspend the voting rights and right to use the Common Facilities of any Member' for any period during which any assessment or other amount owed by the Member to the Association remains unpaid or during which such Member is in violation of any of the provisions of this Declaration.
It is important to pay your assessment on time to ensure the continuation of services provided to the members of the association. Collection remedies are granted to the Association by the governing documents. The Association's collection policy is listed with our governing documents, but the Property Manager can also provide you with a copy upon request.

Most mortgage companies no longer escrow for annual assessments. Do not assume they do. Before sending your statement to them, call (Mortgage Company) and verify that they do escrow for your assessments. It is your responsibility to make sure the assessment is paid on time.

To obtain a fob, please visit the Management Office at 11620 West Torino Reale Drive, Richmond, Texas 77406 between the hours of 8:30 am and 5pm M-F. Homeowner/Tenant will need to fill out applicable forms, agree to abide by the Governing Documents/Policies/Rules and pay $10.00 per fob (maximum of 6 fobs per household). We do not accept cash. Please bring check or money order (no cash)
If you are a new homeowner, you will need to bring your closing documents and picture ID.
If you are leasing a home, we will need landlord verification (please visit Association Documents Page and review Guidelines for Residential Leases and Rental Agreements).
If you have lost your amenity fob or just need an additional fob, please bring your picture ID along with payment.
If your fob is broken or has stopped working, please bring in the fob to exchange it for a new fob at no charge.

Parks and playgrounds are not available for rent or reservation. They are considered "open space" and are for the use of all residents and their guests. The parks and playgrounds are on a first come first serve basis. Parks are open for use during daylight hours seven (7) days a week. If your event has music, please be respectful of the surrounding homes.

In accordance with Texas property code section 209.016 (e) all owners renting their properties must submit the following information in writing to the association regarding their lease or rental applications within 1o days of the lease being signed: a. contact info for each tenant b. commencement date and term of the lease c. landlord's current physical mailing address and phone number. Per the Association's governing documents, the property is to be used for single family purposes only. Homeowners are responsible for the maintenance of the individual driveways and sidewalks. Please refer to your property deed for additional information and verification.
Fort Bend County Road and Bridge is responsible for the maintenance and striping of the public streets. Streets within the gated neighborhoods are considered private and are maintained by the Community Association and funded from the neighborhood's reserves.

Private mailboxes are maintained by homeowners. If your private mailbox needs to be repainted, please remember that the color of the mailbox must remain black. No, but you are welcome to participate in the community garage sales. The community hosts two annual garage sales every year. The management team will send out communications a month prior to the dates.
Permanent goals may be permitted with the prior approval of the ACC. According to the ACC Design Guidelines: Poles may not violate side or rear building lines, and are not permitted on the rear of a lake lot. Goals may not be attached to side-load, swing-in or front-load garages. Backboards may be mounted on a detached garage only. Backboard must be commercially manufactured and neutral in color. Only a shooting square outline shall be visible. Mounted poles are to be metal. No wood poles are permitted. Portable basketball goals, such as Hydro Huffy Sports or similar are permitted. Portable goals located in the driveway of a home must be removed from public view or placed no further forward than the front facade of the home before retiring for the evening. The portable goal must be well maintained and kept in good repair at all times. All basketball goals must have a net at all times. No chain nets are permitted.
DCC&R Article V. Section 1. w. No antenna, tower, satellite dish or similar device for receiving and or sending signals shall be erected, constructed or placed on any lot for any purpose without prior written approval from the ACC committee. However, in no case shall any such devices be allowed on corner lots and lake front lots. The ACC will comply with any federal, state or county law, regulation or order regarding such devices including not limited to the telecommunications act of 1996.
DCC&R Article V. Section 1. h. No animals, livestock, or poultry shall be raised, bred, or kept upon any Lot, or portion thereof, except that no more than a total of three (3) dogs, cats, or other household pets of domestic variety may be kept, provided that they are not kept, bred, or maintained for any commercial purposes, and provided that they do not create a nuisance.
DCC&R Article V. Section 1. m. Motor homes, campers, travel trailers, inoperative vehicles, motor boats, house boats, sailboats or other similar waterborne vehicle or any trailer to transport such boat or vehicle (hereinafter collectively referred to as "Vehicles") are not permitted on the Property unless maintained, stored or kept on any Lot only in an enclosed garage or screened from public view behind a solid fence located behind any Lot building lines. No motor vehicles shall remain in the same general location on a street or in a driveway for more than 14 days in any 30 consecutive day period.
DCC&R Article V. Section 1. v. No business vehicles displaying commercial signage or advertising shall be permitted to be parked within public view within the subdivision, other than service vehicles contracted by owners or occupants to perform specific services. No vehicles with more than two axles shall be permitted to be parked or stored for a period in excess of 12 hours per week within the subdivision without prior written permission of the association, whose approval will be issued at its sole and absolute discretion.
DCC&R Article V Section 1.b. No sign including political signs, advertisements, billboards, or advertising streams of any kind shall be displayed, maintained or placed in the public view on or from any part of the property or on any lot except signs temporarily used by declarant or any owner on a lot of not more than 6 square feet, advertising on the lot for sale or rent, or signs of architects and builders during the period of construction and sale improvements on any lot.
Our Landscape Company and Onsite Maintenance Contractor remove bandit signs on the community property. If you notice signs in the community requiring removal, please contact the Management Office or log into the Resident Portal and create a request. We will have the signs removed and contact the company or group that installed the signs.
Texas Elections Code 259.002
Sec. 259.002. REGULATION OF DISPLAY OF POLITICAL SIGNS BY PROPERTY OWNERS' ASSOCIATION. (a) In this section, "property owners' association" has the meaning assigned by Section 202.001, Property Code.
(b) Except as otherwise provided by this section, a property owners' association may not enforce or adopt a restrictive covenant that prohibits a property owner from displaying on the owner's property one or more signs advertising a candidate or measure for an election:
(1) on or after the 90th day before the date of the election to which the sign relates; or
(2) before the 10th day after that election date.
(c) This section does not prohibit the enforcement or adoption of a covenant that:
(1) requires a sign to be ground-mounted; or
(2) limits a property owner to displaying only one sign for each candidate or measure.
(d) This section does not prohibit the enforcement or adoption of a covenant that prohibits a sign that:
(1) contains roofing material, siding, paving materials, flora, one or more balloons or lights, or any other similar building, landscaping, or nonstandard decorative component;
(2) is attached in any way to plant material, a traffic control device, a light, a trailer, a vehicle, or any other existing structure or object;
(3) includes the painting of architectural surfaces;
(4) threatens the public health or safety;
(5) is larger than four feet by six feet;
(6) violates a law;
(7) contains language, graphics, or any display that would be offensive to the ordinary person; or
(8) is accompanied by music or other sounds or by streamers or is otherwise distracting to motorists.
(e) A property owners' association may remove a sign displayed in violation of a restrictive covenant permitted by this section.

DCC&R Article V Section 1.u. No trade or business may be conducted in or from any dwelling or Lot, except that an Owner of Occupant may conduct business activities within a dwelling so long as (a) the existence or operation of the business activity is not apparent or detectable by sight, sound or smell from outside the dwelling; (b) the business activity conforms to all zoning requirements and other restrictive covenants applicable to the Lot; (c) the business activity does not involve regular visitation of the dwelling or LOBT by clients, customers, suppliers or other business invitees or door-to-door solicitation of residents of Lakes of Bella Terra; and (d) the business activity is consistent with the residential; character of the Subdivision and does not constitute a nuisance, or a hazardous or offensive use, or threatens the security or safety of other residents of Lakes of Bella Terra, as may be determined in the sole discretion of the Architectural Control Committee. A day-care, nursey, pre-school, or other similar activity is expressly prohibited.

The Association contracts with a mosquito fogging company to spray gated and non-gated streets throughout Lakes of Bella Terra as needed through the year.

We are fortunate to have beautiful lakes and native areas. Everyone needs to be aware that we have significant wildlife and signage is posted for your benefit. Please do not feed any of the wildlife and maintain distance. Several of our alligators are quite large and have been highlighted on the local news. In most cases, Animal Control Officers will remove dead stray animals from public property (except freeways) within 72 hours. Smaller dead wildlife may be brought to one of the area shelters for disposal. Dor more information, contact Fort Bend County Animal Services at 281-342-1512.

Lakes od Bella Terra requires all animals to be on a leash when out on the property. We ask that owners be good neighbors and properly dispose of animal excrement. If you notice a stray or unleashed animal or have concerns that an animal is creating an unsafe environment, contact Fort Bend County Animal Services at 281-342-1512
